A class action lawsuit is a procedure that allows one or more individual plaintiffs to sue on behalf of a class of employees who have been injured in a similar way. With overtime cases, a class action is sometimes preferable to bringing an individual claim, since the costs of the lawsuit are spread out over more parties. In addition, in class actions, the court is responsible for setting the amount of the plaintiffs’ attorney’s fees, and this amount is typically paid by the employer. Because of these factors, in certain cases, a plaintiff in a class action could actually recover more than he or she could by bringing an individual claim. |
